Is Your Motorcycle Still Under Warranty?
When determining if your motorcycle is covered under the California Lemon Law, you will first need to determine if it is still under warranty. If you bought the motorcycle new, then the manufacturer’s warranty is the one that would cover it. If you bought the motorcycle ‘used,’ you would need to determine if the manufacturer’s warranty was still in effect when you bought it, or if the dealer provided an express warranty at the time of purchase.
Does Your Motorcycle Have Serious Safety Defects?
If your motorcycle has defects that affect its safety, such as faulty brakes, and the manufacturer or dealer has attempted to repair the defect on at least two or more occasions without success, then you may be covered under the California Lemon Law. You may be entitled to get all of your money back for the cost of the motorcycle or you may choose to have the motorcycle replaced.
Has a Non-Safety Defect Sent Your Motorcycle to the Shop Over and Over Again?
If the defect is not likely to cause injury or death, then the manufacturer or dealer will be afforded more time to repair the motorcycle. In most cases, they will have up to four attempts to repair the motorcycle; though in some instances, they may be afforded more attempts.
